SO THIS ITEM IS, UH, A PUBLIC HEARING FOR, UM, AMENDMENT OF THE ZONING ORDINANCE TO, UH, REPEAL SECTION 27 SIGNED REGULATIONS AND ADOPT A NEW CHAPTER.

CHAPTER 17, SIGNED REGULATIONS OF THE COURT OF ORDINANCE OF THE CITY OF AUBREY.

UM, THE SIGN REGULATIONS WERE ORIGINALLY ADOPTED AS A NEW SECTION OF THE ZONING ORDINANCE IN FEBRUARY, 2010.

AND SINCE THEN, UH, IN LAST YEAR IN JUNE, THERE WAS A, UH, UH, NEW SET OF STANDARDS, UH, APPROVED BY COUNCIL.

UH, BUT SINCE THEN, THE CITY HAS DETERMINED THAT SIGNED REGULATIONS ARE MORE APPROPRIATELY ADMINISTERED AS A STANDALONE CHAPTER OF THE COURT OF ORDINANCES INSTEAD OF AS PART OF THE ZONING ORDINANCE.

AND THIS DETERMINATION IS BASED ON THE FOLLOWING CONSIDERATIONS THAT SIGNED REGULATIONS ARE APPLICABLE WITHIN THE CITY LIMITS, AS WELL AS IN THE ETJ, WHILE ZONING ORDINANCE IS ONLY APPLICABLE WITHIN THE CITY LIMITS.

SO THIS CREATES A, A AMBIGUITY REGARDING ETJ ENFORCEMENT, UH, OF THE SIGN REGULATIONS.

A STANDALONE CHAPTER IS EASILY LOCATED, REFERENCED, AND APPLIED BY CITY STAFF, APPLICANTS AND THE PUBLIC WITHOUT NAVIGATING THE ZONING ORDINANCE.

FRAMEWORK ENFORCEMENT OF SIGN STANDARDS IS NOT CONS CONSTRAINED BY THE PROCEDURAL OR JURISDICTIONAL LIMITS OF THE ZONING ORDINANCE.

AND, UH, A STANDALONE CHAPTER IS MORE VISIBLE AND ACCESSIBLE TO THE RESIDENTS, BUSINESSES AND DEVELOPMENT COMMUNITY.

THIS AMENDMENT IS TO ADE THE SIGN REGULATIONS VERBATIM FROM SECTION 27 OF THE ZONING ORDINANCE TO THE NEW CHAPTER, CHAPTER 17 OF THE CODE OF ORDINANCES.

UH, IN ORDER TO ACCOMPLISH THIS, THE SECTION 27 WILL BE REPEALED IN ITS ENTIRETY, AND A NEW CHAPTER 17 OF THE CODE OF ORDINANCES WILL BE ADOPTED.

THIS AMENDMENT IS PURELY ADMINISTRATIVE AND WILL NOT IMPACT THE, UH, PRACTICAL APPLICATION AND ENFORCEMENT OF THE SIGN REGULATIONS.

AND AS WELL AS A TRAINING FACILITY, UH, THIS AMENDMENT IS TO, UH, CHANGE THE FUTURE LAND USE DESIGNATION FROM RURAL LIFE TO PUBLIC INSTITUTIONAL.

THE 10 ACRE PARCEL WAS RECENTLY ANNEXED, UH, IN MARCH, 2026.

ANNEXATION WAS INITIATED TO ACCOMMODATE CITY PLAN CONSTRUCTION OF THE FIRE STATION NUMBER FOUR AND A CENTRALIZED TRAINING FACILITY.

UH, EXISTING FUTURE LAND USE IS RURAL LIFE AND THE REQUESTED FUTURE LAND USE DESIGNATION IS PUBLIC INSTITUTIONAL.

THE SURROUNDING AREA INCLUDES A MIX OF RURAL RESIDENTIAL PROPERTIES, AGRICULTURAL TRACKS, AND DEVELOPING SUBURBAN NEIGHBORHOODS.

THE COMPREHENSIVE PLAN DESIGNATES AREAS IN THE VICINITY AS RURAL LIFE, RESIDENTIAL, MEDIUM DENSITY, PARK SATURATION, AND OPEN SPACE, PUBLIC INSTITUTIONAL AND FLOODPLAIN.

THE PROVISION OF PUBLIC SERVICE FACILITIES INCLUDES A, UH, FIRE STATION, UH, IS AN OBJECTIVE, UH, OF THE 2045 COMPREHENSIVE PLAN.

PUBLIC INSTITUTIONAL FUTURE LAND USE DESIGNATION IS MORE APPROPRIATE FOR, UH, THIS TYPE OF USE, UH, ESPECIALLY SINCE THE CITY HAS IDENTIFIED THIS SITE AS A CRITICAL PUBLIC SAFETY AND TRAINING FACILITY.

FIRE STATION AND PUBLIC SAFETY FACILITIES ARE GENERALLY COMPATIBLE WITH A WIDE VARIETY OF SURROUNDING LAND USES AND HAVE MINIMAL IMPACT DURING NORMAL OPERATIONS.

THIS SITE WILL ALSO HAVE DIRECT ACCESS, UM, FROM FM 29 31, WHICH IS A ARTERIAL ROADWAY.

SO THE EMERGENCY VEHICLES WOULD, UH, HA WOULD NOT NEED TO GO THROUGH RESIDENTIAL STREETS.

THEY'LL JUST GO DIRECTLY TO THE ARTERIAL STREET.

THE PRELIMINARY PLAT APPLICATION SHOWS THE REVISED LOCK CONFIGURATION CONSISTENT WITH THE APPROVED CIVIL PLANS.

THE PRELIMINARY PLAT ILLUSTRATES 12 LOCKS WITH NINE COMMERCIAL LOTS AND THREE RIGHT AWAY, RESERVATION LOTS.

INDIVIDUAL SITE PLAN APPROVAL WILL BE REQUIRED FOR EACH COMMERCIAL LOT PRIOR TO BUILDING PERMIT ISSUANCE, AND THE SITE WILL BE SERVED BY ACCESS POINTS TO US 3 77 AND WATER AND SEWER WILL BE PROVIDED BY THE CITY OF AY STAFF IS REVIEWED THE PRELIMINARY PLAT AND RECOMMENDS IT FOR APPROVAL.
