THE HIGH POINT RANCH IS A MASTER PLAN COMMUNITY LOCATED EAST OF US 3 77 SOUTH OF BLACKJACK IN NORTH OF SPRING HILL ROAD.

THE PROPERTY WAS ZONED IN PLA AS A PLAN DEVELOPMENT DISTRICT IN SEPTEMBER OF 23.

A PREVIOUS PRELIMINARY PLAT FOR THE OVERALL HIGH POINT DEVELOPMENT WAS APPROVED.

UM, BUT IT'S EXPIRED.

IT EXPIRED IN 22.

UH, SINCE THAT TIME, HIGH POINT HAS BEEN SUBMITTING PRELIMINARY PLATS SIMULTANEOUSLY WITH FINAL PLATS, UM, ON A PHASE BY PHASE BASIS.

THIS PRELIMINARY PLAT INCLUDES 86 RESIDENTIAL LOTS, TWO HOA LOTS.

THE SITE WILL BE SERVED BY ACCESS POINTS TO US 3 77 AND THE FUTURE OUTER LOOP, UH, BY BRONCO LANE, WHICH IS IN A PREVIOUS, UH, PHASE OF THE DEVELOPMENT.

SINCE THE POSTING OF THE AGENDA, UM, THE APPLICANT HAS RESUBMITTED A PRELIMINARY PLAT THAT HAD SOME CON, WE HAD SOME CONDITIONS THAT THEY NEEDED TO ADDRESS AND THEY'VE ADDRESSED MOST OF THOSE.

UM, THERE WAS ONE ITEM LEFT.

UH, PRIOR TO THIS MEETING, WE DID RECEIVE A REVISION, BUT WE HAVE NOT HAD A CHANCE TO REVIEW IT YET.

THE CITY ENGINEER, CINDY PLANNER, UH, RECOMMEND UH, THIS PRELIMINARY PLAT FOR CONDITIONAL APPROVAL WITH THE ONE CONDITION THAT YOU SEE THERE.

UM, THE AUBREY CODE OF ORDINANCES EXHIBIT 10 A, THE SUBDIVISION ORDINANCE ARTICLE THREE, SUBDIVISION DESIGN STANDARDS IN SECTION EIGHT REQUIRES FRONT SIDE AND REAR SETBACK LINES ON PLATS.

THE SETBACK LINES SUMMARY TABLE APPEARS TO BE INCONSISTENT WITH THE DEVELOPMENT AGREEMENT AND MUST BE CORRECTED ACCORDINGLY IS THE CONDITION THE PLANNING AND ZONING COMMISSION MAY RECOMMEND TO CITY COUNCIL APPROVAL OF THE PRELIMINARY PLAT, APPROVAL OF THE PRELIMINARY PLAT WITH CONDITIONS OR DENY THE PRELIMINARY PLAT.

SO THIS, THIS IS SOMETHING THAT IF IT WAS APPROVED WITH THE CONDITIONS, IT IS GOING TO BE YES.

SO THE BROUGHT UP TO CODE THE YES, THE WAY THE CONDITIONAL APPROVAL, UM, IT'S INTENDED FOR WHEN THERE'S CORRECTIONS THAT CAN BE MADE THAT STAFF CAN APPROVE THEREAFTER SUBMITTED.

THE, THE FINAL PLAT FOR BELMONT PHASE ONE, UM, WAS APPROVED IN AUGUST OF 23 AND IT WAS FILED WITH THE COUNTY.

UH, THE DEVELOPMENT INCLUDES 150 SINGLE FAMILY RESIDENTIAL LOTS AND IT IS WITHIN THE ETJ OF THE CITY OF AUBREY.

UM, A SCRIBNER'S ERROR WAS LATER IDENTIFIED BY THE OWNER AND THEY HAVE SUBMITTED AN AMENDED PLAT.

UH, THEIR SUBMITTAL WAS ON NOVEMBER 12TH AND THE AMENDMENTS INCLUDED CORRECTING THE OWNER'S CERTIFICATION STATEMENT TO REFERENCE DEN DENTON COUNTY INSTEAD OF THE CITY OF AUBREY, AS THE PROPERTY DOES LIE IN THE COUNTY.

IT ALSO UPDATED THE PD, UH, SINGLE FAMILY BUILDING SETBACKS REQUIREMENT TO A 10 FOOT SETBACK.

UM, THERE WAS JUST AN ERROR IN THE SETBACK BLOCK THAT'S ON THE PLAT, SO THAT CORRECTION WAS MADE.

UH, THE CITY ENGINEER AND PLANNER HAVE REVIEWED THE AMENDED PLAT AND THEY DO RECOMMEND IT FOR APPROVAL.

AND TONIGHT THE PLANNING AND ZONING COMMISSION MAY RECOMMEND A COUNCIL APPROVAL OF THE AMENDED PLAT APPROVAL OF THE AMENDED PLAT WITH CONDITIONS, OR YOU MAY DENY THE AMENDED PLAT.
