J AND L CONSTRUCTION SUBMITTED THE LOWEST BID FOR $717,240 AND 50 CENTS.

ACTUALLY, AS I'M SITTING HERE, I GOT AN UPDATE ON THE LEGISLATIVE SESSION, UM, AS OF THE END OF DAY TODAY.
AND THE BOTTOM LINE IS THIS, AND THIS IS GONNA SET THE SCENE FOR HOW, UM, RESTRICTIVE SOME OF THE PROPOSED LEGISLATION IS.
UM, MUNICIPAL DEBT REFORM, TAX RATE RELIEF ARE THE MAJOR FOCUSES OF OUR LEGISLATION.
BOTH VOTED AND NON-VOTING DEBT WILL BE LIKELY AFFECTED.
THE SESSION ENDS AND JUNE 2ND AND, AND CURRENTLY, UM, RIGHT NOW, UM, THE PROPOSALS FOR ELECTED BONDS ARE THAT IT'S GONNA HAVE TO SAY IN, IN, UM, LARGE LETTERS, THIS IS A TAX INCREASE WHEN YOU VOTE FOR SOMETHING AND NO LIKELY THAT ONLY A NOVEMBER ELECTION DATE FOR ALL BOND ELECTIONS FOR ALL ENTITIES IN THE STATE OF TEXAS.
YOU'LL HAVE TO BE EXTENSIVE DUE DISCLOSURE ABOUT THE DEBT OUTSTANDING AND WHAT THE IMPACT ON THE DEBT WILL BE FOR THEM.
AND THE, UM, IF YOU ACTUALLY NOW HAVE A, A BALLOT AGENDA THAT HAS A NUMBER OF DIFFERENT ITEMS YOU HAVE TO PUT INTO

HISTORICALLY, WE'VE ISSUED CERTIFICATES OBLIGATION TO EITHER FUND UTILITIES OR FUND GENERAL OB GENERAL FUND TYPE ITEMS. AND THE REASON BEING IS IT'S CALLED THE TEXAS DOUBLE BARREL PLEDGE.
WE PLEDGE VALOREM TAXES AND REVENUES.
OUR SYSTEM, IF WE'RE GONNA FUND SOMETHING WITH A TAX AND, UH, STREETS OR SIDEWALKS, WHAT WE WOULD SAY IS IT'S GONNA BE AVALOR TAX.
AND A LIMITED NET REVENUE PLEDGE MIGHT BE LIMITED TO $1,000 FOR AN ENTIRE LIFE ISSUE THAT ALLOWS US TO PLEDGE THAT DEBT SERVICE TO IT.
IN THE CASE, WHEN WE DID, UM, THE UTILITY FUND RECENTLY, WE'D SAY ADDOR TAX AND UNLIMITED NET REVENUES.
WHEN IT SAYS NET REVENUES, WE CAN'T TAKE MONEY.
WE HAVE TO OPERATE OUR SYSTEM, MAKE SURE PEOPLE HAVE WATER AND IT WORKS.
BUT WE, WE, IN THAT CASE, WE BUDGET FOR OUR FULL PAYMENT, WE DON'T EXPECT TO PAY TAXES FOR IT.
SO HERE'S WHAT THE CURRENT IS.
THE CURRENT, UM, PROPOSAL IS, UH, THE PETITION THRESHOLD WILL BE FROM FIVE PER REDUCED FROM 5% TO 2%.
IT'LL BE RESTRICTED FOR ONLY EMERGENCY USES.
STREETS UTILITY PROJECTS CAN BE FUNDED AND BY COS GOING FORWARD, BUT THEY'RE GONNA REQUIRE THAT SEALS GET PAID OUTTA THE
WHAT CAN'T BE FUNDED ARE THINGS THAT WE DO FUND, WHICH WOULD BE POLICE, FIRE, PARK, LIBRARY, PARKING, MAJOR MAINTENANCE OF THE EXISTING FACILITIES.
THINK OF ALL THE THINGS WE'VE ACTUALLY FUNDED OR TALKED ABOUT FUNDING IT, IT, YOU CAN'T FUND THEM AND PRACTICALLY IT'S HARD TO FUND ANYTHING IF YOU'RE PUT ON YOUR
UH, THERE'S A PROHIBITATION, THE PROHIBIT ISSUANCE OF COS FOR FIVE YEARS AFTER A BOND ELECTION WOULD FAIL ON THAT TYPE OF ASSET CATEGORY.
SO IF WE HAD A BOND ELECTION, UM, ON A PROGRAM, IT USED TO BE THREE YEARS, UM, AND, AND NOW IT'S GONNA BE FIVE YEARS.
ALSO, THEY ELIMINATE THE BILL TO DO TAX NOTES FOR FIVE YEARS.
PREVIOUSLY, IF YOU HAD A BOND ELECTION FAILED OR IF YOU HAD A CERTIFICATE OBLIGATION THAT WAS PETITIONED, YOU COULD DO A TAX NOTE FOR SEVEN YEARS AND FUND GET SOMETHING GOING.
BUT NOW NEITHER CAN BE FUNDED FOR FIVE YEARS.
SO IT'S GONNA BE VERY DIFFICULT TO FUND ANY OF THE NOT TRADITIONAL ITEMS. SO AS A RESULT, UM, I'VE SPENT SIGNIFICANT TIME WITH MIKE AND ANNE AND CHARLES TALKING ABOUT WHAT CAN THE CITY FUND AND, UM, IN FACT YOU ARE LIKE MANY OF OUR CITIES, TRYING TO THINK ABOUT MAYBE MOVING FORWARD A LITTLE BIT ABOUT THINGS THEY WOULD'VE DONE OVER THE NEXT YEAR OR TWO JUST TO GET THEM DONE.
BECAUSE IT'S GONNA BE HARD, UM, TO FUND THINGS IN THE FUTURE.
AGAIN, IT'LL BE TURNING TO VOTED BONDS AND YOU CAN IMAGINE WALKING IN NOVEMBER TO THE BALLOT BOX.
UM, AND THERE'S THE SCHOOL DISTRICT AND IT'S GONNA BE THE COUNTY AND WHO KNOWS WHO ELSE WILL BE ON THERE, BUT IT'S WHAT'S GONNA TAKE PLACE.
SO WITH THAT, WE DID ANALYSIS AND, AND, AND I'M GONNA SUMMARIZE THAT CITI ACTUALLY HAS, UM, SOME SIGNIFICANT CASH ON HAND RIGHT NOW.
AND BY USING THE CASH TO BUFFER THE, THE, THE PAYMENTS, UNTIL WE CAN GROW INTO THEM, WE CAN ISSUE $70 MILLION WITHIN OUR CURRENT INS TAX RATE.
UM, OUR UTILITY FUND IS VERY PROFITABLE.
THE PLAN HAS BEEN PUT IN PLACE COMBINATION OF UTILITY CASH FLOW AND IMPACT FEE USAGE, FULLY FUNDS, WHAT WE PREVIOUSLY FUNDED AND WHAT WE HAVE IN FUNDS.
UM, WE'RE LOOKING AT DOING THE CERTIFICATES OF OBLIGATION UNDER CURRENT LEGISLATION.
UM, AND THIS COMBINATION OF
THERE'S GONNA BE SOME GENERAL FUND PROJECTS.
THERE'S GONNA BE SOME UTILITY FUND PROJECTS, TAXES EXEMPT, 25 YEAR AMORTIZATION, UM, STANDARD 10 YEAR PAR CALL STANDARD TO GET THE EFFICIENT PRICING ON THE BOND.
CITY'S GOT A GREAT AA BOND RATING, I BELIEVE WE'LL CONFIRM OUR AA BOND RATING.
WE'VE TALKED TO THE, UH, RATING C ABOUT ISSUING DEBT.
THEY KNOW WE'RE GONNA BE ISSUING DEBT.
THE ONLY THING THAT WOULD ISSUING DEBT'S NOT GONNA IMPACT US.

IT'S STUNNING HOW, WHAT'S STAFF IN PLACE? UM, WE'RE USING CURRENT INTEREST RATES PLUS 25 BASIS POINTS OF, UM, APRIL 22ND, THOUGH I'VE GOT GOOD NEWS FOR MIKE.
RATES HAVE COME DOWN ABOUT 28 BASIS POINTS SINCE THEN.
YOU KNOW, I DID A PRESENTATION, WE RAN SOME NUMBERS EARLIER AND, AND WE'RE RATE UNDER A SIMILAR RATE AS SOMEBODY WE WERE ACTUALLY TALKING ABOUT 4 97.

SO THEY ACTUALLY HAVE INDICATED THEY'RE GONNA MAKE THE BILL EFFECTIVE SEPTEMBER 1ST AND ONLY THINGS THAT ARE ISSUED AND CLOSED CAN DO THAT.
SO USUALLY WE, YOU, YOUR STAFF AND, AND, UM, I SUPPORT THEM.
THEY, THEY GO THROUGH AN EXTENDED PROCESS.
THEY'D RATHER GET THESE PROJECTS DONE.
THERE'S, THERE'S NO CHANCE TO GET EXTENDED PROCESS TO BE DONE.
SO WHAT HAVE WE PROPOSED WITH IS THERE'S 50 MILLION, UM, OF INS FUND A PACKAGE OF ASSETS, 20 MILLION, UH, FOR THE UTILITY FUND FOR A TOTAL OF $70 MILLION.
UM, IT'S GONNA BE 137 IN TOTAL DEBT, 5.4 MILLION.
UM, IT'S GONNA BE AVERAGE ANNUAL.
AND, AND THAT'S THE AVERAGE ANNUAL.
BUT YOU'LL SEE LATER THAT WE KIND OF BACK LOAD IT BECAUSE AGAIN, WE'RE GOING 25 YEARS AND WE'RE KIND OF RAPID AROUND OUR EXISTING DEBT TO HAVE LEVEL OVERALL DEBT.
AND HERE'S ANOTHER REASON THAT THAT'S GONNA BE PROHIBITED FROM HAPPENING IN THE FUTURE.
I HAVEN'T TALKED TO MICHAEL ABOUT THIS YET, BUT THE, THERE'S ACTUALLY SOME, SOME ALSO DEBT AMOUNT AND STRUCTURE LIMITATIONS WHERE THE WAY THAT YOU CAN DETERMINE HOW MUCH DEBT YOU CAN ACTUALLY ISSUE IN ANY PARTICULAR YEAR, YOU HAVE TO LOOK AT YOUR AVERAGE INS YOUR AVERAGE, EXCUSE ME, YOUR AVERAGE ABOR TAX COLLECTION FOR THE LAST THREE YEARS.

AND TAKING THE OPPORTUNITY FOR THIS FUNDING OPPORTUNITY FOR A EXPENSIVE PIECE OF EQUIPMENT IS WHY I PUT IT IN THERE.
